These Terms of Service (“Terms”) govern your access to and use of our websites, mobile applications, and related online services (collectively, the “Services”) provided by Fitify Workouts s.r.o. (“Fitify”, “we”, “us” or “our”).

By continuing, creating an account, clicking a button such as “Register”, “Continue”, “Buy now” (or similar) when this notice is shown, or by otherwise using the Services after being informed of these Terms, you enter into a binding agreement with us and agree to comply with these Terms. If you do not agree to these Terms, you may not access or use the Services.

These Terms incorporate our Privacy Policy by reference. Please read these Terms and Privacy Policy carefully before using our Services.

Who we are

Fitify Workouts s.r.o. is a company incorporated under the laws of the Czech Republic, with its registered office at Na Perštýně 342/1, 110 00 Prague, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 394109.

Fitify Services

Fitify will make the Services available to customers based on these Terms of Service.

Upon your acceptance of these Terms, Fitify grants you a non-exclusive, limited, non-assignable, and non-sublicensable license to use the Services only in accordance with the selected functionalities, i.e., functionalities that are free of charge or paid (the “License”). The License is granted for the duration of the contractual relationship between Fitify and you under these Terms and applies to all general updates, maintenance, or free of charge upgrades of the Services. The License automatically terminates upon the expiry of your paid subscription or, for free Services, when you permanently cease using the Services, which may be indicated by, but is not limited to, uninstalling the mobile application from all your devices or deleting your user account. For the avoidance of doubt, uninstalling the mobile application from your device does not terminate your payment obligations for any active Paid Services or your contractual relationship with Fitify for such Paid Services.

You must not, and will not permit others to:

  • Sell, sublicense, rent, lend, or in any other manner distribute the Services or any intellectual property rights therein or otherwise make the Services available to other persons;
  • Use or access the Services in violation of any applicable law or intellectual property and/or personality rights of third parties;
  • Use or access the Services in a manner that threatens the security or functionality of the Services, or for any purpose or in any manner not expressly permitted in these Terms;
  • Create, collect, transmit, store, use, or process the Services in a manner that violates any law; or infringes, violates, or otherwise misappropriates the intellectual property or other rights of any third party, including any moral right, privacy right, or right of publicity;
  • Reverse engineer, modify, decompile, or disassemble the Services or any portion thereof, or make any other attempt to ascertain the composition or the properties or characteristics of the Services;
  • Tamper with, breach, or attempt to probe, scan, or test for vulnerabilities in the Services;
  • Upload into the Services malware or any files that contain corrupted files, viruses, or any other programs that may damage or adversely affect the operation of the Services;
  • Remove or obscure any proprietary notices or labels in the Services, including brand, copyright, trademark, and patent or patent-pending notices;
  • Access or use the Services for the purpose of building a similar or competitive product or service, or perform any vulnerability, penetration, or similar testing of the Services;
  • Attempt to override or bypass safety filters, prompts, or restrictions placed on the AI features ("jailbreaking"), or use the AI features to generate content that is illegal, hateful, sexually explicit, or otherwise violates these Terms.

You can use any content in the Services only for the duration of and in accordance with the License. You may neither change, reproduce, translate, distribute, publish, create, or use derivative works of, communicate to the public, or otherwise use the Services and their content, nor use the name or designation of the Services and their content in any way

Suspension of Access, Scheduled Downtime, Modifications

Fitify may, at its discretion, suspend your access to or use of the Services or any component thereof, in the following cases:

  • scheduled maintenance;
  • if you violate these Terms, especially the conditions of the License, or upload illegal content to the Services;
  • if the information provided by you is false or inaccurate;
  • if your conduct violates any relevant laws or regulations, such as those related to copyright and intellectual property;
  • if your behavior towards Fitify employees, partners, contractors, agents, or other users is deemed threatening, abusive, or harassing;
  • if Fitify needs to address emergency security concerns;
  • while Fitify is modifying the Services.

Fitify reserves the right to release updates, patches, and bug fixes to the Services. All general updates, maintenance, or upgrades will be generally available to you. You are not obliged to download and install any updates of the Services, but in such a case, Fitify cannot guarantee the functionality of the Services. Fitify is also entitled to make any modifications or changes to the Services, including its complete inaccessibility, without any compensation, at its discretion and without prior notice.

User-Generated Content

By uploading any content into the Services (e.g., content uploaded under your user account such as photos, reviews, comments, inputs provided to AI features and other materials), you grant to Fitify a non-exclusive, worldwide, unlimited in quantity, royalty-free and fully paid up, freely assignable and sublicensable, perpetual (i.e. for the duration of the respective economic rights) license to use such content as reasonably necessary to operate, provide, improve, and promote the Services.

Fitify is entitled to use your content in its original or altered form and to modify, reproduce, translate, distribute, publish, create and use derivative works of, communicate to the public or otherwise use your content to any extent and in any way necessary for the operation of the Services. Fitify is also entitled to use your name and image in connection with your content without any restrictions, to the extent permitted by applicable law.

You are solely responsible for the content that you upload to the Services. You are prohibited from advertising commercial websites or other products through your user account in the Services. You cannot create or share content that is pornographic, sexual, violent, racist, inciting violence, discriminatory, explicit, insulting, and/or libelous in nature. You must and hereby undertake to ensure that you will hold and maintain all necessary rights to the content that you upload to the Services.

Fitify is entitled to, at its discretion or at the initiative of a third party or competent public authority, modify, delete, or block content that, among other things, is:

  • false, unlawful, misleading, defamatory, abusive, obscene, pornographic, ambiguous, harassing, incriminating, infringing the rights of third parties, vulgar, fraudulent, or otherwise inadmissible, racist, or inciting religious fanaticism, hatred, or physical harm of any kind;
  • includes any mentions, indications, expressions, images, or other graphics, sound, or other medium that would constitute, incite, encourage, or induce the commission of an illegal activity or crime, be capable of causing harm, or infringe the rights of any third party; and/or violates any generally binding legal regulations;
  • capable of damaging, in any way, the device on which the Services are provided, Fitify’s servers, or the devices of other users of the mobile application;
  • that conflicts with our Terms.

In cases where you would be the provider of such content, Fitify reserves the right to suspend and, if necessary, delete your user account within the Services for the necessary period.

For the sake of clarity, you express your explicit consent to the conditions of this Section of the Terms by accepting the Terms during the registration process in the Services (i.e., by clicking on the button “Register” on your device).

Artificial Intelligence (AI) Features

Our Services may include features powered by Artificial Intelligence ("AI"), including but not limited to the AI Personal Trainer, Meal Scanner, AI articles & courses, Form Correction, and interactive coaching.

  • Accuracy and Reliability: You acknowledge that AI systems are probabilistic and may produce inaccurate, incorrect, or offensive results ("hallucinations"). Fitify does not guarantee the accuracy, completeness, or usefulness of any response generated by the AI. You should not rely solely on AI-generated advice for medical, nutritional, or safety decisions.
  • No Medical Advice: AI-generated content is for informational and recreational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always verify AI recommendations (e.g., meal plans or exercise forms) with a qualified professional, especially if you have pre-existing health conditions.
  • User Inputs: You are responsible for the text, images, video, and audio you submit to our AI features ("Input"). You must ensure your Input does not violate the law or the rights of others.
  • Third-Party Providers: Our AI features are powered by third-party providers (such as OpenAI and Google). By using these features, you acknowledge that your Inputs may be processed by these providers as described in our Privacy Policy.

Services and Prices

Free Services

If you use the Services free of charge, you only have access to some basic functions and information of the Services. More functionalities are available to you in the case you enable custom content modules separately in return for a one-time payment or for a subscription fee. Classification of the Services as free of charge or paid may change over time based on the current functionality of the Services at a given time.

To use some of the Services to the greatest extent, some equipment or other items may be required (e.g., Kettlebell, Gym Ball, Medicine Ball, Food, Fitness gear, Fitness mat, etc.). These are not part of the Services and need to be purchased by you at your own cost.

Certain parts of the Services are provided for a fee (“Paid Services”). Paid Services may be offered as (i) automatically renewing subscriptions (“Subscriptions”) or (ii) non-recurring one-off purchases, such as lifetime access or individual content or feature unlocks (“One-Off Purchases”).

Trials

Fitify may offer you free trials (the “Trial”) for certain paid Services (“Paid Services”) for a specified Trial period. To begin the Trial, we require your payment details. By providing such details, you initiate the Trial period and consent that automatic charging of the agreed payment may begin for the chosen subscription of Paid Services on the first day following the end of the Trial period on a recurring basis. If you do not want to accept this charge, you must cancel the applicable subscription of Paid Services no later than 24 hours before the Trial period ends.

Prices

The applicable price for the Paid Services, Subscriptions, or One-Off Purchases will be clearly displayed to you in the Services prior to your completing the purchase. The price displayed at the "Point of Purchase" (the checkout screen) is the final binding price for that specific transaction or initial subscription period.

Dynamic Pricing and Variations: Prices may vary depending on your territory, applicable local taxes (such as VAT or Sales Tax), the distribution platform (e.g., App Store vs. Website), and current active promotions. Fitify reserves the right to test different pricing models, offers, and features at any time. You agree that the price offered to you is valid only for the duration displayed at the time of purchase and may not be available to other users or at a later time.

Price Changes: Fitify may change the price for Paid Services and Subscriptions from time to time. To the maximum extent permitted by applicable local law, you accept the new price by continuing to use the Services or maintaining your active Subscription after the price change takes effect. If you do not agree to a price change, you have the right to reject it by unsubscribing from the Paid Services before the change takes effect.

Lifetime Access Definition: If you purchase a "Lifetime" plan, this grants you access to the specific purchased features for as long as those features are made available by Fitify. "Lifetime" does not refer to the user's lifespan, but to the operational life of the purchased feature(s). Fitify reserves the right to discontinue the Service or specific features at any time, at which point the "Lifetime" access will terminate without refund.

Your Health

Use of the Services is at your own risk. You must be in a good general state of health to use Fitify. If you are aware of any pre-existing medical conditions, we advise you to seek medical advice before you start using our Services.

Especially if you have any of these medical complaints/conditions/procedures: Cardiovascular disease, Lung or respiratory diseases, Spinal and/or joint problems, Neuromuscular disease, Surgical procedures, and any other health issues.

Please note that our training and coaching are not intended for children. Pregnant women and breastfeeding mothers should consult a physician before using our training and coaching, and may be advised not to use certain plans or exercises.

Nutritional Advice and AI: In the case of nutritional advice, you have the responsibility to verify that all foods and nutrients recommended by us do not contain anything to which you are allergic or which may cause you a food intolerance. The nutritional data (calories, macronutrients) provided by the app, particularly data generated by the AI Meal Scanner, is an estimate only. We do not guarantee the accuracy of this data. It should not be used for medical purposes (such as managing diabetes or eating disorders). You are responsible for verifying portion sizes and ingredients.

No Medical Advice: Our Services and advice are in no case a substitute for medical advice, examination, or treatment. We do not guarantee that the use of the Services will bring the results intended by you. We do not promise or guarantee any muscle gains, fat loss, etc. The actual training result depends on many factors, which cannot be influenced (genetics, physical disposition, and medical preconditions, etc.).

You should always consult an expert (e.g., physician, medical expert, or certified trainer) regarding the use of the Services. Fitify is not responsible for (i) the state of your health, and (ii) the suitability of our exercises or exercise plans for your health and body.

Data Protection

We hereby agree to process any and all information, including personal data, received hereunder with due care.

We will not, in any manner whatsoever, collect, gather, retain, disseminate, disclose, process, or use confidential information, including personal data, or consolidate it with any other information without a due legal ground.

We protect all personal data processed within the Services in compliance with the requirements set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (the “General Data Protection Regulation”) and other applicable legal regulations.

Depending on where you live, you may also benefit from additional privacy rights under local laws (for example, certain US state privacy laws). These rights, and how to exercise them, are described in more detail in our Privacy Policy.

User’s Account

In order to use our Services, you need to comply with all legal requirements of the country of your residence. You may only use the Services if you are at least the minimum age required in your country to form a contract with us. In particular, our Services are not directed to children under 16 years of age, and such children are not permitted to use the Services. In jurisdictions (such as the United States) where a lower age limit (e.g., 13) applies for online services, we comply with that limit but still do not knowingly allow younger users to register. You represent that any registration information that you provide to Fitify is and will be true, accurate, and complete. You agree to update information in your registration if any of your information changes.

To use the Services, you must typically download and install the application or access our website, register, and open a user account. It is sufficient to open only one user account, even if you wish to use several Services. You can open a Fitify user account on our website or via one of our mobile apps. Do not use domain names or web URLs in your username without prior written approval from us.

It is not possible to complete the registration without entering the data marked as mandatory. We will ask you to accept these Terms and our Privacy Policy during the registration process.

If you create a Fitify user account using an email address and password, we may ask you to verify your email address. In that case, we will send you an email asking you to confirm your registration by clicking on the “Confirm account” (or similar) link. After you have clicked on this link, you may be redirected to a website or in-app screen where we confirm your registration. Your registration is complete once you have provided the required information and, where applicable, confirmed your email address.

You can also open a Fitify user account by using your existing Facebook, Apple ID, Huawei, or Google account. In case of registration through such an existing account, you are obliged to check the accuracy of the data transferred from your existing account and, in the event of any inaccuracy, correct it immediately. The registration process is completed once you have entered your Facebook, Apple, or Google account details and confirmed that you wish to use them with Fitify. In these cases, we may not send a separate confirmation email.

When Your Contract Begins

When registering on our website or installing our mobile applications, the contract between you and us is formed when you click on the “Install” field and enter your password (if required) in the relevant app store, or when you complete the registration or purchase flow on our website and confirm your acceptance of these Terms (for example by clicking a button such as “Sign up”, “Buy now”, “Continue” or similar). Kindly note that the contract between you and Fitify does not concern the relationship between you and the supplier (Apple, Google, Huawei, FastSpring, Paddle, etc.).

Conclusion of a Contract for One-Off Additional Services for a Fee or for Subscriptions

Additional services can be purchased by you either by paying a one-time fee or as part of a subscription. If you purchase the additional service via your mobile app, the contract is formed when you click on the field “Buy now” or a similar field, as part of an in-app purchase, and enter your password if required.

If you purchase additional services via our websites, the contract is formed when you click on the relevant order button (for example, “Buy now”, “Continue” or similar) and successfully complete payment via our payment partners (such as Stripe, Paddle, or FastSpring). You will receive a confirmation email and/or receipt and other necessary access credentials at the email address you provided during checkout. Please ensure that this email address is correct and that you keep these messages for your records.

Payments

We reserve the right to assert further claims for late payments.

If you purchase our Services via in-app purchases, you will be billed by the app-store provider (Google Play, Apple App Store, Huawei AppGallery).

If you purchase our Services and your payment is not processed by an app-store provider, it will be processed by our external payment partners (such as Stripe, Paddle, or FastSpring, depending on your location and chosen offer). These partners may act as payment processors and/or merchants of record, and their own terms and privacy policies may apply in addition to these Terms. We do not store your full payment card details.

If any costs and/or expenses are incurred by us because a payment is declined and this is your fault (e.g., because there are insufficient funds in the account or the credit card limit has already been exhausted), then we are entitled to bill you for the actual costs and/or expenses incurred.

You are responsible for providing current, complete, and accurate billing and contact information for all purchases and for promptly updating this information if it changes. In case of a legitimate reason, we reserve the right to refrain from offering certain payment methods and to specify alternative payment methods.

Cancellations and Refunds

By completing your purchase of any Paid Services, you consent to us making the digital content and functionality available to you immediately. To the maximum extent permitted by applicable law, you acknowledge and agree that all fees and other payments for the Paid Services are final and non-refundable, and that we have no obligation to provide any refund or credit, except where a refund is required by applicable law.

While Fitify is under no obligation to do so, we may, in certain limited circumstances and at our sole discretion, decide to issue a refund, credit, or extension of access as a goodwill gesture. Any such decision is made on a case-by-case basis and does not create an obligation for us to do so again in the future.

You may cancel your Paid Services at any time. Unless otherwise required by applicable law, cancellation will take effect at the end of your then-current subscription period. You will continue to have access to the Paid Services you have already paid for until the end of that period, and no pro-rated or partial refunds will be provided for any unused portion of the subscription period.

The way you can cancel or request a refund (if any) depends on where you purchased the Paid Services. In many cases (especially app store purchases), billing and any potential payments are fully controlled by the relevant third-party marketplace. In those cases, we cannot process payments directly for you.

If you need help managing your subscription or believe you have been charged in error, please contact us at [email protected]. To help us locate your purchase quickly, include: the email address used for the purchase, the platform or provider (Apple App Store, Google Play, Huawei AppGallery, Paddle, Stripe, FastSpring), the approximate date, amount, and currency of the charge, and any receipt, order ID, or transaction number you have.

Apple App Store (iOS Purchases)

Billing for Apple App Store purchases is processed directly through Apple.

You can manage, pause, or cancel your Fitify subscription purchased via Apple in your device settings under your Apple ID subscriptions. When you cancel, your subscription will stay active until the end of the current billing period and will not renew. No partial refunds are provided for the remaining period.

Steps to manage your subscription on Apple App Store:

  • Launch the Settings app on your device.
  • Tap on your Apple ID.
  • Tap on Subscriptions.
  • Select the Fitify subscription.
  • Tap cancel, pause, or use other options.

We do not have the technical ability to issue a refund for these purchases. If you wish to request a refund, you must do so directly from Apple using their standard refund process (for example, via the “Report a Problem” link in your Apple receipt email or via your Apple account settings). Any decision to grant a refund is made solely by Apple in accordance with its policies.

Google Play (Android Purchases)

If you purchased the Paid Services via Google Play, billing is processed by Google.

You can manage, pause, or cancel your Fitify subscription purchased via Google Play in the Google Play app under Subscriptions. When you cancel, your subscription will stay active until the end of the current billing period and will not renew. No partial refunds are provided for the remaining period.

Steps to manage your subscription on Google Play:

  • Launch the Google Play Store app.
  • Tap on your profile icon in the top right.
  • Tap on Payments & subscriptions and then Subscriptions.
  • Select the Fitify subscription.
  • Tap Cancel subscription and follow the instructions.

Google’s refund policies apply, and refunds are handled by Google in accordance with those policies. If you wish to request a refund, you should follow the process in your Google Play account (for example, via your order history or subscription settings).

Huawei AppGallery Purchases

If you purchased the Paid Services via Huawei AppGallery, billing is processed by Huawei or its payment partners. You can manage and cancel your Fitify subscription purchased via Huawei AppGallery in your AppGallery account under Subscriptions or Payment and Purchases (or a similarly named section). When you cancel, your subscription will stay active until the end of the current billing period and will not renew. No partial refunds are provided for the remaining period.

Steps to manage your subscription on Huawei AppGallery:

  • Launch the AppGallery app
  • Click Me
  • Click Account center
  • Click Payment and Purchases
  • Click Subscriptions and choose Fitify

Refund eligibility and procedures are determined by Huawei’s policies. To request a refund or manage billing issues, you should follow the instructions available in your AppGallery account or on Huawei AppGallery’s support pages. We are not able to override Huawei’s decisions about refunds.

Paddle Purchases

For some purchases outside the app stores, our order process is conducted by our online reseller and Merchant of Record, Paddle.com (“Paddle”). Paddle handles billing, tax, and invoicing for these purchases.

Managing or canceling your Paddle subscription

  • Open the receipt or order-confirmation email you received from Paddle after purchase.
  • Click the “Manage Subscription”, “View Billing History”, or similar link in that email.
  • You will be taken to Paddle’s customer-facing subscription management page, where you can:
    • view your subscription details and billing history
    • update your payment method
    • cancel automatic renewal of your subscription
  • When you cancel via Paddle, your subscription will normally remain active until the end of the current billing period and will not renew. No partial refunds are provided for the remaining period unless required by applicable law.

Refunds for Paddle purchases

Refunds for Paddle purchases are not guaranteed. To the maximum extent permitted by applicable law, all payments are final and non-refundable, and we have no contractual obligation to provide a refund or credit.

However, we may decide, at our sole discretion and on a case-by-case basis, to request that Paddle process a refund or credit on our behalf as a goodwill gesture. Any such decision does not create an obligation for us to offer similar treatment in the future.

To request a refund for a Paddle purchase or if you cannot access your subscription, please contact us by opening the Fitify app, going to settings / Contact Us. Alternatively, email us at [email protected] and include:

  • the email address used for the purchase
  • the Paddle receipt or order number (if available)
  • the approximate date, amount, and currency of the charge
  • the last four digits of the card used (if applicable)

We will review your request in line with these Terms, applicable law, and Paddle’s policies, and we may need to coordinate with Paddle for the technical processing of any approved refund.

FastSpring Purchases

For some purchases outside the app stores, our order process is conducted by our online reseller and Merchant of Record, FastSpring (“FastSpring”). FastSpring handles billing, tax, and invoicing for these purchases.

Managing your FastSpring subscription

  • Open the receipt or subscription activation email you received from FastSpring.
  • Click the “Manage Your Orders” or similar link in that email.
  • Follow the instructions to access your FastSpring Account Management page.
  • In your Account Management page, open the Subscriptions tab and use the available options to update your payment method or cancel future renewals of your subscription.
  • When you cancel via FastSpring, your subscription will normally remain active until the end of the current billing period and will not renew. No partial refunds are provided for the remaining period unless required by applicable law.

Refunds for FastSpring purchases As with other web purchases, payments are generally final and non-refundable. We may, at our discretion and subject to applicable law and FastSpring’s policies, decide to request a refund or credit via FastSpring as a goodwill gesture.

To request a refund for a FastSpring purchase or if you cannot access your subscription, please contact us by opening the Fitify app, going to settings / Contact Us. Alternatively, email us at [email protected] and include:

  • the email address used for the purchase
  • the FastSpring order ID or invoice number (if available)
  • the approximate date, amount, and currency of the charge
  • the last four digits of the card used (if applicable)

Stripe (Direct Payments)

If you purchase Paid Services directly on our website or app using a bank card or other payment method processed by Stripe (“Stripe Purchases”), your contract for the Paid Services is with Fitify Workouts s.r.o., not with Stripe. Stripe only processes payments on our behalf.

Managing your subscription (Stripe Purchases)

For Stripe Purchases, you can manage your subscription and payment method via the link in your receipt or order-confirmation email:

  • Open the receipt or order-confirmation email you received from us after purchase
  • Click the “Manage subscription”, “Billing settings”, or similar link in that email.
  • You will be taken either to Stripe’s secure customer portal or to Fitify’s own billing portal, where you can:
    • view your active subscriptions and invoices
    • update your payment card or other payment method
    • change your plan or billing period (where available)
    • cancel automatic renewal of your subscription

If you cancel a Stripe Purchase subscription, it will stay active until the end of the current billing period and will not renew. No additional renewal charges will be made for that subscription after the cancellation takes effect. Unless required by applicable law, we do not provide partial or pro-rated refunds for any unused portion of the billing period.

If you are unable to access your subscription using the steps above, please contact us by opening the Fitify app, going to settings / Contact Us. Alternatively, email us at [email protected] and include:

  • the email address used for the purchase
  • your full name
  • the approximate date, amount, and currency of the charge
  • the last four digits of the card used (if applicable)
  • any receipt or order ID you have (for example, from Stripe or your bank statement).

Refunds for Stripe Purchases

To the maximum extent permitted by applicable law:

  • All payments for Stripe Purchases are final and non-refundable.
  • We have no contractual obligation to provide a refund or credit once the digital content and functionality have been made available to you.

However, we may decide, at our sole discretion and on a case-by-case basis, to issue a refund, credit, or access extension as a goodwill gesture. Any such decision does not create an obligation for us to offer similar treatment in the future.

To request a refund for a Stripe Purchase, please contact [email protected] and provide the purchase details listed above. If we approve a refund, we will instruct Stripe to process it back to your original payment method. Depending on your bank or payment provider, it may take several business days for the refunded amount to appear in your account.

Special Deals and Promotions

Fitify may, from time to time, offer deals, sales, and promotions, such as reward programs. You can stay informed of these deals via our newsletter only if you provide the necessary consent to receive such deals. The sales are normally only offered for a limited time. There are separate conditions for these deals, which are provided for purposes of information and participation.

Liability and Guarantees

We also make no representation, warranties of any kind, express or implied, nor do we guarantee that access to the Services will be uninterrupted or error-free. For correct functioning and full utilization of the Services, you must use the Services on hardware and software that fulfill the minimum configuration requirements available on the Apple App Store and Google Play listing of the service.

Statutory provisions apply to claims due to defective services. Your consumer rights remain unaffected in any case.

By agreeing to these Terms, you also acknowledge that:

  • Fitify is the provider of the hosting and does not proactively control the user content published or disseminated through the Services by its users, and in no case is it responsible for such content.
  • Some user content in the Services may be sourced from third parties, and Fitify is not responsible for the correctness, timeliness, completeness, or any other informative value of such third-party content.
  • User content does not represent the opinions, statements, or other attitudes of Fitify and therefore cannot be associated with Fitify or its business name;
  • Fitify does not provide, to the extent permitted by generally binding legal regulations, any quality guarantee or other guarantees for the Services. This disclaimer specifically extends to any advice, content, or analysis generated by AI features. Fitify is not liable for any errors, omissions, or physical injury resulting from your reliance on AI-generated instructions.
  • Use of the Services is at your own risk, and Fitify is not liable for any damage, injury, loss of income, profits, damage to reputation, data, or business opportunities that may arise for you while using or in connection with the provided Services, or delay or denial of access to them.
  • If you violate the conditions mentioned in these Terms, you are obliged to indemnify Fitify against any third-party claims arising from such infringement. You are obliged to provide assistance in clarifying the disputed situation. Fitify reserves the right to assert claims for damages and other claims.

Changes to These Terms

Fitify reserves the right to modify or replace these Terms at any time at its sole discretion. For non-material changes (e.g., typos, formatting, or minor clarifications), we may simply publish the revised Terms on our website or within the application without direct notice to you. The "Last Edited" date at the bottom of the Terms will be updated to reflect the change.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide a notice prior to any new terms taking effect. We may provide this notice by displaying a notice within the Services (for example, a banner, pop-up, in-app message, or push notification), sending an email to the address associated with your account, or other appropriate means. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services and must stop using them immediately.

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Czech Republic, with the exclusion of conflict-of-law rules.

All disputes between us and you arising out of or in connection with these Terms shall be settled primarily by mutual agreement and without undue delay. If the mutual agreement cannot be reached according to the previous paragraph within 30 days, you may at any time turn to the competent general court, the Czech Trade Inspection Authority, or your competent local administrative public body.

The Czech Trade Inspection Authority is entitled to out-of-court settlement of consumer disputes in the event the consumer is a party to the contract from which the dispute is based. However, the Czech Trade Inspection Authority is not entitled to make a binding decision in the matter. The general courts of the Czech Republic are competent to resolve all disputes in a binding manner. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us and you regarding our Services and supersede and replace any prior agreements we might have between us and you regarding the Services.

Severability and Survival

Any provisions of these Terms found by a tribunal or court of competent jurisdiction to be illegal or unenforceable will be severed from this Agreement, and all other provisions of this Agreement will remain in full force and effect.

Notwithstanding any cancellation, expiry, or termination of these Terms, the provisions contained herein relating to confidentiality, liability, compensation for damages, license to User Generated Content, and governing law and dispute resolution shall continue to apply indefinitely, as well as any other provisions which, by their nature, remain in force after the termination hereof.
